This course covers the substantive, jurisdictional, and procedural law and regulations that pertain to litigation over the validity of issued patents before the Patent Trial and Appeal Board of the United States Patent and Trademark Office. The student will learn the various types of litigations that exist, the differences between them, their differing policy justifications, and their strategic and tactical uses by both patent owners and patent challengers. The class also covers the relationship between PTAB litigation and traditional litigation over patent validity in the courts. Students participate in a simulation
of a PTAB litigation, and prepare and present a simulated oral argument to the PTAB.
